*Each claim must be submitted within 30 days of the relevant purchase date. Any claim submitted more than 30 days after the purchase date will not be accepted.
Eligible claimants: Open to Australian residents aged 18 years or over at the time of claim.
How to Claim:To claim a reward, the claimant must complete the following steps:

1. During the Purchase Period, purchase a pack of BabyLove SleepyNights nappies from any retailer in Australia that stocks the product; and

2. If they are not satisfied with the product, during the Claim Period, visit https://babylovenappies.com.au/sleepynights-guarantee and follow the prompts to the Promotion claim page; and fully complete and submit the online claim form with:

    a. their personal details (first name, last name, date of birth, email address, mobile number and residential address);
    b. an answer to the question “Tell us why the product didn’t work for you*”;
    c. a scanned copy or photo of the receipt for the qualifying transaction; and
    d. confirmation (by tick-box) that they are able to redeem a Coles or Woolworths eGift card.

* A customer service representative may be in touch following submission of the form to understand the feedback. Claimants must provide their reason and explanation for their experience with the product as part of the claim. Claims are subject to verification of proof of purchase, eligibility, and fraud or duplicate checks. The Promoter will not reject an otherwise valid claim on the basis that it disagrees with the claimant’s stated reason for dissatisfaction.

Proof of Purchase: The claimant must retain proof of purchase. The proof of purchase required is the original receipt for the qualifying transaction, which must clearly show the date of purchase (within the Purchase Period) and the qualifying product as a pack of BabyLove SleepyNights nappies.
Claims permitted:Maximum one (1) eligible claim per household.
Reward:A cashback reward of up to AUD $18.50 per eligible claim (being the purchase price paid for the qualifying product as shown on the receipt, capped at AUD $18.50), delivered as a Coles or Woolworths eGift card (claimant’s choice on the claim form).

Claimants must be able to redeem the eGift card at a Coles or Woolworths store or online. Claimants will be required to confirm this ability at the point of claim.

Reward Description Value (per reward) The reward is a cashback equal to the purchase price paid, capped at AUD$18.50 (inclusive of GST) of the participating product (paid by way of a Coles or Woolworths eGift card delivered electronically by email). Up to AUD$18.50
Further Reward Details:The cashback reward will be delivered electronically as a Coles or Woolworths eGift card (at the claimant’s nominated choice) sent via email to the email address nominated on the claim form, within fourteen (14) days of claim approval. Use of the eGift card is subject to the terms and conditions of the issuing retailer (see clause 10).

Claimants are responsible for providing complete and accurate personal or contact details. The Promoter will not be responsible for any non-delivery, delay, loss or misuse of an eGift card resulting from incorrect or incomplete information provided by the claimant, or the claimant’s failure to monitor the nominated email inbox (including spam/junk folders).

Failure to provide correct personal or contact details may, at the Promoter’s discretion, result in forfeiture of the cashback reward.
  1. The claimant agrees and acknowledges that they have read these Conditions of Claim (and the Schedule) and that claiming a reward in the Promotion is deemed to be acceptance of these Conditions of Claim (and the Schedule). Any capitalised terms used in these Conditions of Claim have the meaning given in the Schedule, unless stated otherwise. Offer not valid in conjunction with any other offer.
  2. The Promotion commences at the start of the Purchase Period and ends at the end of the Claim Period. Claims are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the claimant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
  3. Valid and eligible claims will be accepted during the Claim Period. Each claim must be submitted within thirty (30) days of the relevant purchase date. Any claim submitted more than thirty (30) days after the purchase date will not be accepted.
  4. Employees (and their immediate family members) of the Promoter, of agencies and companies directly associated with the conduct of this Promotion, of businesses involved in determination of successful claimants for the Promotion, of businesses involved in the management of the Promotion, of any organisation benefiting from the Promotion, and of the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies, are not eligible to claim. For the avoidance of doubt, employees of retail stores selling the Promoter’s products are not excluded by this clause. “Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. For the purposes of these Conditions of Claim, “household” means all persons residing at the same residential address, regardless of relationship.
  6. Claimants must keep their proof of purchase specified in the “How to Claim” section as proof of purchase (“Proof of Purchase”). If a claimant fails to produce the Proof of Purchase as and when requested by the Promoter, the Promoter has the right to invalidate the claimant’s claim and/or forfeit the claimant’s right to the reward. The Proof of Purchase must clearly specify: (a) the date of purchase, which must fall within the Purchase Period; and (b) the qualifying product as a pack of BabyLove SleepyNights nappies.
  7. No part of a reward is exchangeable, redeemable for cash or any other reward, or transferable, unless otherwise specified in writing by the Promoter.
  8. Each reward will be awarded to the person named in the claim and any claim that is made on behalf of a claimant or by a third party will be invalid. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  9. Claimants’ personal information will be collected by the Promoter directly or through the Promoter’s agents or contractors. Personal information will be stored on the Promoter’s database. The Promoter collects personal information about claimants to enable them to participate in this Promotion and may disclose the claimants’ personal information to its related entities and third parties including its contractors and agents, reward suppliers and service providers to assist in conducting this Promotion. The Promoter may send claimants email or SMS messages relating primarily to the conduct of this Promotion (such as claim status updates and reward delivery notifications) without an unsubscribe facility, in accordance with section 16(3) of the Spam Act 2003 (Cth). Separately, the Promoter will only send marketing communications to claimants who have expressly opted in via the tick-box on the claim form, and every such marketing communication will include a functional unsubscribe facility. If the claimant does not provide their personal information as requested, they may be ineligible to claim a reward in the Promotion. The Promoter’s Privacy Policy (see babylovenappies.com.au/privacy) includes information about: (a) how a claimant can seek access to the personal information the Promoter holds about them and seek correction of the information; and (b) how to complain about a privacy breach and how the Promoter will deal with such a complaint.
  10. The reward is a Coles or Woolworths eGift card supplied by a third party. Claimants are required to confirm at the point of claim that they are able to redeem the eGift card at the relevant retailer (in store or online). The eGift card is subject to the issuing retailer’s terms and conditions, including any expiry date and redemption restrictions, available at coles.com.au/giftcards and woolworths.com.au/shop/discover/about-us/gift-cards. The terms and conditions which apply to the reward at the time it is issued to the claimant will prevail over these Conditions of Claim in the event of any inconsistency. To the extent permitted by law, the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the reward, any delay or failure relating to the reward itself, or failure by the third party to meet any of its obligations.
  11. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Claim restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  12. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected claims, or suspend or modify a reward, subject to State or Territory regulation. For the avoidance of doubt, valid claims submitted in accordance with these Conditions of Claim before the date of any such cancellation, termination, modification or suspension will be honoured.
  13. The Promoter reserves the right, at any time, to validate and check the authenticity of claims and a claimant’s details (including a claimant’s identity, age and place of residence). If a claimant cannot provide suitable proof as required by the Promoter to validate their claim, the claimant will forfeit the reward in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible claims, as applicable, will at the Promoter’s discretion be deemed invalid and not eligible to claim a reward. Claims containing offensive or defamatory comments, or which breach these Conditions of Claim, any law or infringe any third party rights, including intellectual property rights, are not eligible to claim a reward. The use of any automated claim software or any other mechanical or electronic means that allows an individual to automatically claim repeatedly is prohibited and may render all claims submitted by that individual invalid.
  14. The Promoter reserves the right to disqualify claims in the event of non-compliance with these Conditions of Claim. If there is a dispute concerning the conduct of the Promotion or claiming a reward, the Promoter will resolve the dispute in direct consultation with the claimant. If the dispute cannot be resolved the Promoter’s decision, acting reasonably, will be final.
  15. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any reward (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
  16. The Promoter may invite claimants to participate in marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed. Participation is voluntary and any such activity will be subject to the claimant’s prior written consent.
  17. The Promoter accepts no responsibility for any tax implications and the claimant must seek their own independent financial advice in regards to the tax implications relating to the reward or acceptance of the reward.
  18. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
  19. These Conditions of Claim are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that State.
