Paw Patrol 2023 Movie Promotion Terms and Conditions

1)         General

a. Information on how to enter and the prizes form part of these Terms and Conditions.

b. Entry into the PAW Patrol x BabyLove Movie Consumer Promotion (“the Promotion”) constitutes acceptance of these Terms and Conditions.

c. The Promoter is Unicharm Australasia Pty Ltd (ABN 33 006 884 546), of 1 Hargrave Place, Mentone, VIC, 3194 (“the Promoter”).

d. For the purposes of the Terms and Conditions, Unicharm Australasia Pty Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.

2)         Entry requirements

a. Entry is open to Australian residents only.

b. Entrants under 18 years of age will need to have the consent of their parent or guardian to enter the Promotion.

c. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

d. Entry to the Promotion is free.

e. The Promotion commences at 9:00am (AEST) on Thursday 21st September 2023 and closes at 11:59pm (AEDST) on Wednesday 4th October 2023 (“the Promotion Period”).

f. To enter the Promotion, participants must during the Promotion Period:

  • Visit the BabyLove PAW Patrol Movie Promotion website: www.babylovepawpatrolpromotion.com.au (“Website”) and fill out the required details for the entry form.
  • Input their response to the competition question: If your child became a Mighty Pup, what would their superpower be, and why?
  • Accept the competition terms & conditions.
  • Submit their completed entry via the promotional landing page.

g. Only one (1) entry is permitted per person.

h. Incomplete, late, or indecipherable entries will be deemed invalid.

3)         Judging

a. This is a game of skill, and chance plays no part in determining the winner. Each entry will be individually judged on a combination of fulfilment of the entry requirements, creative merit and originality.

b. There will be ten (10) Major Prize Winners, and ninety (90) Minor Prize Winners selected.

c. There will be two (2) rounds of judging to determine the Minor Prize Winners. The Minor Prize Winners in the first round will not roll over into the second round but will be entered in the Major Prize Winner selection round. Judging for forty-five (45) Minor Prize Winners will be conducted weekly and take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria   3181 at 11am (AEST) on Thursday 28th September 2023 and on Friday the 6th of October 2023, by a representative selected by The Promoter.

d. Judging for the ten (10) Major Prize Winners will take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria 3181 at 11am (AEST) on  Friday the 6th of October 2023, by a representative selected by The Promoter.

e. All winners will be notified via email within one (1) business day of the judgment occurring.

f. Should the Promoter be unable to make contact with any of the chosen winners within  5 business days after selection, the winner(s) will be deemed to have forfeited the prize.

g. Should item 3f come into effect, a representative of the Promoter will select the next best entry/entries to be the Major Prize Winner(s) and/or Minor Prize Winner(s) of The Promotion. This judging will take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria 3181 at 11.00am (ADST) on Thursday the 12th of October 2023.

h. The judgeʼs decision is final, and no correspondence will be entered into.

4)         Prizes

a. Major Prize: Paw Patrol 3 Pack Tray Puzzle, PAW Patrol tablet, PAW Patrol Alarm Clock with calendar & temperature, DIY Colour-in Cardboard Wearables – PAW Patrol Chase Police Car, DIY Colour-in Cardboard Wearables – PAW Patrol Skye Plane, PAW Patrol wireless headphones – Total Prize pack value RRP $127 and Family Movie Pass Admit 4 (2 Adult and 2 children)RRP $60. Major Prize total value RRP $187

b. Minor Prize: The Mighty Movie Family Movie Pass Admit 4 (2 Adult and 2 children aged 15 or under) RRP $60. Redemption of the Family Movie Pass is subject to the standard terms and conditions of the issuer. The Promoter is not responsible for any late, lost, damaged Family Movie Pass.

c. The total prize pool is valued at $7,270 AUD.

d. Prizes, including any unused portion, may not be transferred or substituted, except at the Promoterʼs discretion. The Promoter reserves the right to substitute a prize of equal or greater value and standard due to  prize unavailability.

e. The physical component of the prizes will be delivered to the addresses supplied by Major Prize Winners and Minor Prize Winners

f. The Promoter shall not be liable for any costs associated with the prize after delivery.

5)         Entries

a. All entries must be original and will become the property of The Promoter upon submission. Entries may be used for future promotional, marketing and publicity purposes in any media worldwide.

b. The winnerʼs name and photographs may be used for any future promotional, marketing and publicity purposes in any media worldwide.

c. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrantʼs identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

d. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

6)         Warranties

a. Entrants agree they are fully responsible for any materials they submit as a component of their entry (Entry), including but not limited to their answer to the promotional question. The Promoter shall not be liable in any way for the content of their Entry, to the full extent permitted by law. The Promoter may remove or decline to publish any Entry without notice for any reason whatsoever. Entrants warrant and agree that:

  • they will not submit an Entry that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
  • their Entry shall not contain viruses or cause injury or harm to any person or entity;
  • they will obtain prior consent from any person or from the owner(s) of any property that appears in their Entry.
  • the Entry is the original literary work of the entrant, that does not infringe the rights of any third party;

b. Each entrant warrants that the use or publishing of any entry will not cause the Promoter to be in breach of any third partyʼs intellectual property rights.

c. The Promoter does not take any responsibility for any costs associated with entering and/or accessing The Promotion including and not limited to internet service provider costs.

d. If for any reason the Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or effect the administration security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the Promotion or to disqualify any individual who has tampered with the entry process.

e. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may, in its absolute discretion, cancel the Promotion and/or recommence it from the start on the same conditions.

f. If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to, the Promoter may deem that prize winner ineligible.

g. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:

  • any technical difficulties or equipment malfunction (whether or not under the Promoterʼs control);
  • any theft, unauthorised access or third-party interference;
  • any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  • any variation in prize value to that stated in these Terms and Conditions of entry;
  • any tax liability incurred by the winner or entrant; and/or
  • redemption of the prize.

7)         Privacy

a. The Promoter’s privacy policy can be found at https://babylovenappies.com.au/privacy/

b. The Privacy Policy contains information on: (a) how an entrant may access the personal information that is held by the Promoter and seek correction of such information; and (b) how an entrant may complain about a breach of the Australian Privacy Principles or a registered privacy code that binds the Promoter, and how the Promoter will deal with such a complaint.

c. If an entrant has any questions regarding their privacy, they should contact the Promoter using the contact details contained in this Privacy Policy.

d. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988.
