Nappy Pants Social Promotion Terms and Conditions

BABYLOVE NAPPY PANTS TODDLER PARENTS IN FEED SOCIAL COMPETITION TERMS & CONDITIONS OF ENTRY

  1. General
    1. Information regarding how to enter and the prizes form part of these Terms and Conditions.
    2. Entry into the BabyLove Nappy Pants Toddler Parents (The Promotion) constitutes acceptance of these Terms and Conditions.
    3. The Promoter is Unicharm Australasia Pty Ltd, 1 Hargrave Place Mentone VIC 3194 (ABN 33 006 884 546), (The Promoter).
    4. For the purposes of these Terms and Conditions, Unicharm Australasia Pty Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
  2. Entry requirements
    1. Entry is open to Australian residents aged 18 years or older only.
    2. Individuals must have an Instagram or Facebook account in order to access the promotional post and fulfil the entry requirements.
    3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
    4. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
    5. Entry to The Promotion is free.
    6. The Promotion commences at 12.00pm (AEST) on Thursday the 20th of June 2024 and closes at 11.59pm (AEST) on Thursday the 18th of July 2024. (The Promotion Period).
    7. To enter the Promotion, participants must:
    8. Visit the BabyLove Australia Instagram orFacebook account, https://www.instagram.com/babylovenappies/orhttps://www.facebook.com/BabyLoveNappies/, and locate the promotional post
    9. Input their entry in response to the competition prompt tell us what gives you away as a toddler parent as a comment on the promotional post (Entry).
    10. Submit their completed entry via public comment on the promotional post.
    11. Only one (1) entry is permitted per account.
    12. Incomplete or indecipherable entries will be deemed invalid.
  3. Judging
    1. This is a game of skill, and chance plays no part in determining the winner. Each entry will be individually judged on a combination of fulfilment of the entry requirements, creative merit and originality.
    2. There will be three (3) Major Prize Winners selected.
    3. Judging will take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria 3181 at 12.00pm (AEST) on Friday the 19th of July 2024, and will be undertaken by a representative selected by The Promoter.
    4. All Winners will be notified via Instagram or Facebook private message within three (3) business days of the judgement occurring.
    5. All Winners of The Promotion will be published in the copy of the promotional posts, identified by their username on the platform where they submit their winning entry.
    6. Should the Promoter be unable to make contact with any of the chosen winners within five (5) business days after selection, the winner will be deemed to have forfeited the prize.
    7. Should item 3f come into effect, a representative of The Promoter will select the next best entry/entries to be the Major Prize Winner of the The Promotion. This judging will take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria 3181 at 12.00pm (AEST) on Friday the 26th of July 2024
    8. The judge’s decision is final, and no correspondence will be entered into.
  4. Prizes
    1. Major Prize Winners: Three month supply of BabyLove Nappy Pants (size of the winners choosing) RRP $279.00AUD
    2. The total prize pool is valued at $837.00 AUD.
    3. The prize may not be transferred or substituted, except at the Promoter’s discretion. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability.
    4. The physical component of the Major Prizes and will be delivered to the addresses supplied by the Major prize winners.
    5. The Promoter shall not be liable for any costs associated with the prize after delivery.
    6. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for the liability that cannot be excluded by law.
  5. Warranties
    1. Entrants agree they are fully responsible for any materials they submit as a component of their entry (Entry), including but not limited to their answer to the promotional question. The Promoter shall not be liable in any way for the content of their Entry, to the full extent permitted by law. The Promoter may remove or decline to publish any Entry without notice for any reason whatsoever. Entrants warrant and agree that.
      1. they will not submit an Entry that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
      2. their Entry shall not contain viruses or cause injury or harm to any person or entity;
      3. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Entry.
      4. the Entry is the original literary work of the entrant, that does not infringe the rights of any third party;
    2. Each entrant warrants that the use or publishing of any entry will not cause The Promoter to be in breach of any third party’s intellectual property rights.  
    3. The Promoter does not take any responsibility for any costs associated with entering and/or accessing The Promotion including and not limited to internet service provider costs. 
    4. If for any reason The Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of The Promoter, which corrupt or effect the administration security, fairness, integrity or proper conduct of The Promotion, The Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel The Promotion or to disqualify any individual who has tampered with the entry process. 
    5. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, The Promoter may, in its absolute discretion, cancel The Promotion and/or recommence it from the start on the same conditions subject to state legislation. 
    6. If The Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to, The Promoter may deem that prize winner ineligible.
    7. Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of The Promotion, including, but not limited to, where arising out of the following:
      1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 
      2. any theft, unauthorised access or third-party interference; 
      3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by The Promoters) due to any reason beyond the reasonable control of The Promoters;
      4. any variation in prize value to that stated in these Terms and Conditions of entry;
      5. any tax liability incurred by the winner or entrant; and/or 
      6. redemption of the prize.
  6. Disclaimer
    1. This Promotion is in no way sponsored, endorsed or administered by, or associated with Meta.  
    2. Claimants are providing their information to the Promoter and not to Meta. 
    3. Each claimant completely releases Meta from any and all liability.
