Survey Terms and Conditions

TERMS & CONDITIONS OF ENTRY

  1. General
    1. Information regarding how to enter and the prizes form part of these Terms and Conditions.
    2. Entry into the BabyLove Email Preference Survey constitutes acceptance of these Terms and Conditions..
    3. The Promoter is Unicharm Australasia Pty Ltd, 1 Hargrave Place Mentone VIC 3194 (ABN 33 006 884 546), (The Promoter).
    4. For the purposes of these Terms and Conditions, Unicharm Australasia Pty Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
  2. Entry requirements
    1. Entry is open to Australian residents aged 18 years or older only. 
    2. Individuals must be currently subscribed to the BabyLove database to access the survey and fulfil the entry requirements.
    3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
      Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
    4. Entry to The Promotion is free. 
    5. The Promotion commences at 11am ( AEDT) on Thursday 5th February 2025 and closes at 11.59pm (AEDT) on Friday 28th February 2025 (The Promotion Period). 
    6. To enter the Promotion, participants must:
      1. Have previously requested a sample via the BabyLove website in the past 3 months, open the content preferences email and enter the survey form.
      2. Input their responses into the survey form and agree to opt into the competition.
      3. Submit their completed entry via the survey form. 
    7. Only one (1) entry is permitted per person.
    8. Incomplete or indecipherable entries will be deemed invalid.
  3. Judging
    1. This is a game of chance when it comes to determining the winner which will be randomly selected. 
    2. There will be one (1) Major Prize Winner selected.
    3. Selection will take place at Communicado Marketing Communications of Level 1, 554 High Street, Prahran, Victoria 3181 from 11.00am (AEDT) on Thursday the 5th February 2025, and will be undertaken by a representative selected by The Promoter.
    4. The Winner will be notified via email within three (3) business days of the selection occurring and will be able to select their preferred nappy size (eligible sizes are from size 1 to size 5)
    5. Should the Promoter be unable to make contact with the selected winner within five (5) business days, the winner will be deemed to have forfeited the prize.  
    6. Should item 3e come into effect, the Promoter reserves the right to draw and use those reserves if the original person selected or any subsequent reserve is deemed ineligible after being contacted or is uncontactable after several reasonable attempts by the Promoter to confirm their eligibility to receive the prize. 
    7. The judge’s decision is final, and no correspondence will be entered into.
  4. Prizes
    1. Major Prize Winner: A 3 month supply of BabyLove nappies, in your size of choice (up to size 5).
    2. The total prize pool is valued at up to $299. 
    3. The prize may not be transferred or substituted, except at the Promoter’s discretion. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability. 
    4. The physical component of the Major Prize will be delivered to the addresses supplied by the Major prize winner.
    5. The Promoter shall not be liable for any costs associated with the prize after delivery.
    6. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for the liability that cannot be excluded by law.
  5. Entries
    1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    2. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    3. The Promoter accepts no responsibility for any entries not received by the Promoter or delays due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the entrant.
  6. Warranties
    1. Entrants agree they are fully responsible for any materials they submit as a component of their entry (Entry), including but not limited to their answers to the survey questions. The Promoter shall not be liable in any way for the content of their Entry, to the full extent permitted by law. 
    2. The Promoter does not take any responsibility for any costs associated with entering and/or accessing The Promotion including and not limited to internet service provider costs. 
    3. If for any reason The Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of The Promoter, which corrupt or effect the administration security, fairness, integrity or proper conduct of The Promotion, The Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel The Promotion or to disqualify any individual who has tampered with the entry process. 
    4. If The Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to, The Promoter may deem that prize winner ineligible.
    5. Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of The Promotion, including, but not limited to, where arising out of the following:
      1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 
      2. any theft, unauthorised access or third-party interference; 
      3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by The Promoters) due to any reason beyond the reasonable control of The Promoters;
      4. any variation in prize value to that stated in these Terms and Conditions of entry;
      5. any tax liability incurred by the winner or entrant; and/or 
      6. redemption of the prize.
